Marital Settlement Agreements and Judgments

Marital Settlement Agreements are contracts that resolve some or all of the issues in a dissolution case. If a Marital Settlement Agreement is incorporated into a Judgment of Dissolution, the Marital Settlement Agreement determines how the parties' assets and debts will be divided and assigned, as well as describe the parties' rights regarding child custody and visitation, child support, and spousal support.

Signing a Marital Settlement Agreement may be the most important legal decision you ever make. The agreement may impact the financial well-being of you and your children for many years to come. Unfortunately, people often sign marital settlement agreements without understanding the legal consequences the agreement will have on their assets and finances, both now and in the future. This often arises when the parties think the agreement provides something that it does not or the agreement is silent or ambiguous as to a certain issue that does not come to light until after the agreement is signed. At Timko & LaSorsa, we insure that our clients' achieve the most benefit available to them under the facts of the case and the law, while making sure that our client's Marital Settlement Agreement can withstand legal challenges by the other party in the future.
